General Eligibility: An Eligible Sender and Eligible Receiver (both defined below) must meet the following criteria:

1. Use a compatible version of WhatsApp;
2. Reside in and be physically located in India;
3. Must not be currently employed by Meta or a Meta company; and
4. Have the same WhatsApp account for at least the past 30 days.

Seeing an advertisement for the Promotion does not guarantee that you are eligible to receive a Promotion Incentive. If you do not agree to these Promotional Terms, please do not participate in the Promotion.

Sender Eligibility: In addition to the general eligibility requirements above, an eligible sender of a Qualifying Payment (“Eligible Sender”) will receive no more than three Promotion Incentives and will not be eligible thereafter.

Receiver Eligibility: In addition to the general eligibility requirements above, an eligible receiver of a Qualifying Payment (“Eligible Receiver”):

1. Has not received a Qualifying Payment from the Eligible Sender before; and
2. Has a linked active bank account on WhatsApp payments.

Additionally, WhatsApp may limit the number of transactions an otherwise Eligible Receiver may receive daily, after which the receiver would no longer qualify as an Eligible Receiver.

An Eligible Sender can receive a Promotion Incentive when they satisfy the requirements set forth in these WhatsApp payments promotional terms and conditions (“Promotional Terms”). As a condition of taking any step to claim the Promotion Incentive, offered by WhatsApp Application Services Pvt. Ltd. (“WhatsApp India”), you agree to these Promotional Terms.

Promotional Period: This WhatsApp payments promotion (“Promotion”) period is only available when displayed while making a Qualified Payment on WhatsApp (“Promotion Period”) and may be extended or terminated earlier, by WhatsApp India within its sole discretion. This Promotion is valid only during the Promotion Period, while supplies last.

WhatsApp India, subject to its sole discretion, will provide a one-time payment of ₹35.00 (a “Promotion Incentive”) to the Eligible Sender within 7 days from the date of the completion of the Qualifying Payment.

A “Qualifying Payment” shall mean a successful and final payment to a WhatsApp contact using WhatsApp payments of at least Rs. 1 by an Eligible Sender to an Eligible Receiver, excluding payments sent or requested via UPI ID or scanning a UPI QR code, during the Promotion Period.

The Promotion Incentive will be transferred to the Eligible Sender’s default bank account linked to WhatsApp payments.

The Promotion Incentive is limited to one per Eligible Receiver. An Eligible Sender may receive no more than three Promotion Incentives. An Eligible Sender must complete the Qualifying Payment prior to WhatsApp India’s modification or termination of the Promotion. The Promotion Incentive: (a) shall be available only for ‘peer to peer’ transactions and shall not be available for any transactions involving the purchase of goods/articles from merchants; and (b) is not available for participation to Eligible Senders who are residents of any state/union territory in India where such Promotion Incentives may be prohibited by applicable law.

WhatsApp India is not responsible or liable for any Promotion Incentive: (a) sent to closed or suspended WhatsApp payments accounts, or payments accounts with a default bank account that is unable to receive payments via the Unified Payments Interface (“UPI”); (b) which is disrupted, delayed or fails on account of failures of the intermediaries facilitating the payments; or (c) when the Eligible Sender deregisters from WhatsApp payments by delinking all bank accounts, switching PSPs, moving a SIM card to a new device with cloud or no backup, changing the phone number associated with the WhatsApp account, or deleting or reinstalling their WhatsApp account.

The Promotion Incentive is not offered to, is not intended to be used by, and may not be transferred to any individual or entity (a) who is the target of U.S., United Nations, or applicable non-U.S. trade sanctions; (b) identified on any U.S., United Nations, or applicable non-U.S. government prohibited or restricted parties list; (c) who is located, organized, or resident in a country or region that is embargoed by the U.S. or by the United Nations; or (d) where unlawful under U.S., United Nations, or applicable non-U.S. trade sanctions or export controls. Such persons are ineligible for the Promotion Incentive. The Promotion Incentive may not be used in any manner that is unlawful under export controls or trade sanctions. WhatsApp India reserves the right to deny distribution of any Promotion Incentive when an otherwise Eligible Sender becomes ineligible under (a)-(d) of this section 8 or when in its sole determination such denial is otherwise required by applicable law.

Your use of WhatsApp payments is subject to the WhatsApp India payments terms of service available at: https://www.whatsapp.com/legal/payments/india/terms, and any transaction canceled, refused or otherwise not permitted pursuant to the WhatsApp India payments terms is not eligible for this Promotion. If there is any conflict between these Promotional Terms and the WhatsApp India payments terms, the WhatsApp India payments terms will govern.

This Promotion is not transferable and is void where prohibited. WhatsApp India is not responsible and/or liable for any lost, late, incomplete, illegible, interrupted, delayed, or misdirected payment, activity, submission, or other participation-related materials or Promotion Incentive or if any payment information does not work or is changed. Subject to applicable law, any questions relating to participation or the Promotion will be resolved in WhatsApp India’s sole discretion, and its decisions about any related matter will be final and binding.

WhatsApp India, in its sole discretion, reserves the right to limit, modify, cancel, delay, or revoke this Promotion and/or the Promotion Incentive at any time without notice for any reason, including but not limited to a participant’s suspected abusive or fraudulent use, or for violation of these Promotional Terms.

This Promotion is governed by the laws of India, and the obligations, rights, and remedies of the parties hereunder shall be determined in accordance with such laws, without regard to conflicts of laws principles.

Any dispute arising out of or in relation to these Promotion Terms & Conditions shall be brought exclusively in the competent courts in the State of Telangana.
