WhatsApp Inc. (“WhatsApp,” “our,” “we,” or “us”) provides messaging, Internet calling, and other services to users around the world. The following Pre-Release Terms of Service (“Pre-Release Terms”) apply to your use of pre-release versions of our apps, services, features, or software that include the ability to send and receive payments through designated payment service providers (“PSPs”) in India (“Payments Beta”). The Payments Beta is a “Service” as defined in the WhatsApp Terms of Service (“Terms”), and these Pre-Release Terms supplement the Terms and apply to your use of the Payments Beta. You agree to the Pre-Release Terms when you use the Payments Beta.
Pre-Release Version. You understand and acknowledge that the Payments Beta is being provided as a pre-release version, may contain errors or inaccuracies, and is made available on an “AS IS” and “AS AVAILABLE” basis for the purpose of providing WhatsApp with feedback on its quality and usability. Your testing and feedback will help us to identify bugs and to improve the quality and usability of our Services.
Limited Use. You may use the Payments Beta only for testing and evaluation purposes. We may limit the number of pre-release versions that can be installed, so you may not be able to send payments to or receive payments from all of your contacts. WhatsApp reserves the right to modify the Payments Beta (or any part thereof), either temporarily or permanently, at any time or from time to time, with or without prior notice to you. WhatsApp owns all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services, including the Payments Beta and all modifications and bug fixes. You agree that WhatsApp will not be liable to you or any third party for any modification of the Payments Beta.
Confidentiality. Our communications with you may contain WhatsApp confidential information. WhatsApp confidential information includes the Payments Beta, these Pre-Release Terms, and any materials, communications, and information that are marked confidential or that would normally be considered confidential under the circumstances. If you receive any such confidential information, then you will not disclose it to any third party without our prior written consent. You may disclose WhatsApp confidential information when compelled to do so by law if you provide us reasonable prior notice, unless a court orders that we not receive notice. You will not make any public statement regarding the Payments Beta or these Pre-Release Terms without WhatsApp’s prior written consent. Your obligations under this section will survive the termination of these Pre-Release Terms.
Our Role. The Payments Beta is a service we provide through, and in coordination with, designated PSPs. We provide an electronic platform that enables you to submit transaction instructions to PSPs for processing via the Unified Payments Interface (“UPI”). The PSP’s terms are available here and govern the relationship between the PSP and you. The PSP’s privacy policy is available here and explains its information practices. We are not a licensed financial institution, do not receive, transfer, or store any funds in connection with the Payments Beta, and are not responsible for acts or omissions of PSPs or your bank including the payment, settlement, and clearance of funds. You have a separate relationship with your bank regarding your bank account, and WhatsApp has no affiliation with your bank in this respect.
Age. You must be at least 18 years old to use the Payments Beta.
WhatsApp cares about your privacy. Our Privacy Policy applies to your use of the Payments Beta. In addition to what is described in our Privacy Policy, we receive information to provide the Payments Beta to you, including information you provide when you register to use the Payments Beta and when you send and receive payments. We share information with and receive information from third-party providers and services such as PSPs and Facebook to help us operate the Payments Beta, provide customer support, and keep our Services safe and secure. Please note that the third-party’s terms and privacy policies will govern your use of its services.
Acceptable Use of the Payments Beta. You must access and use the Payments Beta only for legal, authorized, and acceptable purposes, according to our Terms and policies. A PSP or WhatsApp may impose limits on your ability to send or receive payments. A PSP or WhatsApp may also cancel any transaction if we believe the transaction violates the Terms and policies, these Pre-Release Terms, or the PSP’s terms.
Payments Beta Transactions Are Final. Once you submit a payment, it is final. WhatsApp is not liable for unauthorized transactions. We assume no responsibility for the underlying transaction of funds, or the actions or identity of any payment recipient or sender.
Termination. We may modify, suspend, or terminate your access to or use of the Payments Beta and these Pre-Release Terms, at any time for any reason, such as if we determine, in our sole discretion, that you violate these Pre-Release Terms or create harm, risk, or possible legal exposure for us, our users, or others. Upon expiration of the Payments Beta testing period, the Payments Beta may cease to operate, and you may be required to use the commercial version of the Service to continue use. Upon any termination of these Pre-Release Terms for any reason, you must promptly discontinue all use of the Payments Beta.
