Privacy Shield Addendum

A note to EU and Swiss data controllers: WhatsApp has made commitments under the EU-US Privacy Shield and Swiss-US Privacy Shield (together, “Privacy Shield”) that may apply to any personal data of your customers or users (“Customers”) that you transfer to WhatsApp as part of using our Business Products (“Customer Data”). You acknowledge that using Business Products may result in WhatsApp receiving Customer Data in reliance on Privacy Shield. To the extent that Privacy Shield applies to the Customer Data you provide to WhatsApp, and without limiting any agreement between you and WhatsApp, you acknowledge and agree that:
- WhatsApp's Privacy Shield Notice is here and describes WhatsApp's Privacy Shield certification. In accordance with your obligations in connection with your use of the Business Products, you undertake to provide Customers with adequate and appropriate information about the Business Products.
- WhatsApp may make available to data subjects contact information about you via the Business Products, including to allow data subjects to contact you directly to exercise their rights under Privacy Shield.
- WhatsApp may receive inquiries or complaints from data subjects and make available to data subjects an independent recourse and dispute resolution mechanism. Notwithstanding this, you remain responsible for resolving any complaints made to you by data subjects (whether made to you directly or to us) regarding your processing of data subjects' personal data in connection with the Business Products.
- You undertake to take all reasonable steps (including those reasonably requested by WhatsApp) to allow WhatsApp to comply with its Privacy Shield commitments, including to provide assistance to resolve complaints. In the event of a conflict between these terms and other terms that reference these terms, these terms will govern.
